OVERVIEW

Julie Mallen joined Palmersheim & Mathew LLP as an associate in 2019. She has extensive experience serving corporate clients, individual shareholders, sole proprietors, and entrepreneurs in a myriad of complex commercial disputes including breach of contract; breach of fiduciary duty; product liability; and breaches of non-compete, non-disclosure, and non-solicitation agreements.

Recognizing that each client and matter is unique, Julie strives to provide each client a cost-effective and custom approach with respect to risk management and litigation, if necessary.

EXPERIENCE

  • Assisted in quick resolution of class action suit alleging violations of the Telephone Consumer Protection Act with an outcome well below statutory damages.
  • Served as member of trial team on behalf of real estate developer in legal malpractice dispute with management company in connection with ten multi-million dollar real estate development deals where jury returned not guilty verdict for client when damages sought were in excess of $15 million.
  • Obtained early dismissal in age discrimination case against school district.
  • Defended national lender in class action dispute against alleged violations of securities laws and lending laws in federal court in relation to arbitration provision contained in agreement.
  • Obtained partial summary judgment on behalf of partner in a multi-million dollar breach of contract/breach of partnership/breach of fiduciary duty case against former partners arising from profit-sharing agreements and involving counterclaims for misappropriation of trade secrets and breaches of non-disclosure/non-solicitation agreements.
  • Successfully defeated claim against trustee of family trust for breach of fiduciary duty by establishing that complaining beneficiary had full knowledge of the administration and trust activities of various assets and demonstrating that formal accounting was not required due to waiver by disgruntled beneficiary, which decision was upheld on appeal.
  • Obtained dismissal of CEO in securities litigation suit based on jurisdictional issues.
  • Successfully defended national mortgage broker against claims allegations violations of state and federal laws, including the Truth in Lending Act, Real Estate Settlement Procedures Act, and Illinois Consumer Fraud and Deceptive Practices Act.
